TERMS & CONDITIONS

REQUIRED DOCUMENTATION​

All Diving Capital experiences require the completion of a medical questionnaire. In case of any doubt about your health conditions, Diving Capital will require a medical statement issued by a doctor (this can be arranged locally, upon request). In the case of minors, this must be signed by a parent or guardian.

To participate in water activities, proof of certification is required for all experiences that are not at a basic level. Basic level experiences and courses require a minimum participation age of 10 years old. Some other courses and cenotes require a higher age to participate. If you cannot provide proof of certification, you will not be able to dive and may lose all deposits paid.

You must agree to and sign the liability waiver and assumption of risk forms before participating in any water activity. In the case of minors, these must be signed by a parent or guardian.

These terms will fully apply and affect your use of this website. By booking any activity with Diving Capital, you accept all the terms and conditions stated here. You should not use our services if you do not agree with any of these standard website terms and conditions.

You may change the date of your reservation, subject to weather conditions and availability, provided you give us 48 hours’ notice and at no additional charge.

If you need to cancel for any reason, please notify us at least 48 hours before your reservation to receive a full refund, less any transaction, transfer, credit card, or PayPal fees. 

No refunds will be given for cancellations made less than 48 hours before the reservation. The only exception for refunds is the course material costs, which cannot be refunded.

For the period between December 15 and January 15, cancellation notice is extended to 5 days before the reserved activity.

If the participant does not show up for the activity at the designated time and location or cancels less than 24 hours before their reservation, no refunds will be given. We have a zero-tolerance policy regarding drugs and alcohol. If any customer shows signs of being under the influence of drugs or alcohol, no experience will be provided and no refunds will be given.

Cancellations due to illness or other medical conditions that prevent customers from participating in the activity: we will require a written statement from a doctor; in that case, we will do our best to reschedule at no additional cost. If it is not possible to reschedule at that time, the customer will receive a full refund.

Regarding all courses, payment of course fees does not guarantee certification. The student will only be certified when all certification requirements are met, and in the case of failing or not meeting the minimum requirements, there will be no refund. If a student abandons the course halfway through or before completion, there will be no refund.

If rescheduling is not possible at that time, the client will receive a full refund.

All our activities depend heavily on weather conditions, and Diving Capital reserves the right in any circumstance to cancel the tour. In cases where Diving Capital is unable to provide the reserved tour, we will refund all deposits paid to the customer, or we may offer the customer an alternative trip. If an alternative trip is rejected by the customer, Diving Capital reserves the right to deduct the resulting administrative cost from such transactions.

Although every effort is made to meet diving schedules and itineraries, Diving Capital reserves the right to alter diving schedules and itineraries at any time if it is in the client’s interest to do so or if it is forced by weather considerations and/or major external forces.

Diving Capital will not be responsible for any compensation to the client if it is forced to cancel or in any way change trips due to major external forces, namely, war, civil unrest, industrial strike, terrorist activity, natural or nuclear disaster, fire, traffic congestion or any other external circumstance beyond the control of Diving Capital.

The decision of the driver/divemaster/instructor employed by Diving Capital will be final in all matters of safety. A client may be excluded from the trip/course without any refund of the trip/tour if their behavior is considered inappropriate, unsafe, or offensive. If a client is not suitable for a trip/tour, at the complete and sole discretion of Diving Capital, we will cancel the client’s reservation or refuse to take them further if that client poses a danger, inconvenience or nuisance to other clients.
